New York lawyer advertising rules case going to trial

Congrats to Attorney Greg Beck of Public Citizen. Andrew Bluestone reports the law suit brought to prevent enforcement of New York’s new ethics rules is going to trial.

Federal Judge Frederick J. Scullin Jr. denied the state’s motion to dismiss the case and told the parties to get ready for an expedited trial.

Beck, who brought the law suit on the grounds the rules are unconstitutional, said “It is a great victory for us because it will allow us to get a final determination of the constitutionality of these rules pretty quickly. Every day that goes by is another day that those First Amendment rights are being violated.”

The Judge withheld ruling at this time on Beck’s motion for a preliminary injunction against enforcement of the rules.

Again, lawyer blogs, in the opinion of most lawyers, are not covered by the new rules.
