Earlier this year, the DC Circuit Court of Appeals dealt the NLRB quite the blow when it struck down President Obama’s recess appointments to the board. The court handed out more tough love as it today invalidated the NLRB’s rule requiring applicable private-sector employers display a poster informing employees of their labor rights.
