Blogs being used to impeach witnesses

October 1, 2006

As should be expected blogs are being used to impeach witnesses in court.

This in the Boston Globe from Boston employment lawyer, Brigitte M. Duffy, who represents companies that have searched blogs to investigate allegations made by employees:

Blogs raise the same danger that e-mail raised a long time ago, which is that the informal aspects of them make people feel less cautious when they’re writing. But blogs present an even bigger risk because they’re accessible to so many more people and they’re so much more searchable.

This is why law firms must learn RSS now. By using keyword/key phrase RSS feeds from Technorati or NewsGator, lawyers can monitor their clients’ names, subjects of litigation and transactions, witness names and the like.
