Perez : Test case for bloggers use of photography

Ducan Riley shares that a Hollywood photo agency is suing Mario Lavandeira, aka Perez Hilton, for copyright infringement for unauthorized use of the agency’s photos.

Duncan is right that although Perez uses photos more liberally than bloggers, the outcome of the case could have a chilling effect on bloggers.

    I don’t agree that this case could have an adverse affect on bloggers because he has been ripping off photographer’s photos left right and center, usually without attribution.
    When a reputable blogger uses a text source they will provide a link back to that source, and generally only quote a portion of a text, in accordance with the convention of fair use. What Perezhilton is doing is the same as copy and pasting whole articles from elsewhere and not attributing the author.
    Any time a website has done that on a large scale basis they have been set upon and chastised for doing so.
